NEWS: KIBAKI’s appointment of County Commissioners was CONSTITUTIONAL – Court of Appeal

Friday the 14th of June 2013 - The Court of Appeal today overturned a previous ruling given by the High Court that declared that former President Mwai Kibaki had acted against the constitution by appointing 47 County Commissioners.
According to the Court of Appeal, Kibaki acted within the law in appointing the County Commissioners.

The ruling is bound to raise more than a few eyebrows given how controversial the appointment of County Commissioners has been.

At the time Kibaki’s co-principal, Raila Ondinga, opposed the appointment of the commissioners saying it was an attempt to undercut the authority of County Governors.

Some County Governors have clashed with County Commissioners over office space and other issues since their election.

Today’s ruling by the Court of Appeal guarantees that this issues won’t go away anytime soon.
